Thanks to the Internet, it is becoming a widely known fact that the Better Business Bureau (BBB) is simply a private organization that is in business to profit from funding they receive from their local business members and has very little, if any, concern for or affect on business ethics and integrity.

This web page documents the complaint filed with the BBB against Worthington Christian Schools (WCS) and Grace Brethren Church (GBC) (i.e. Grace Polaris and Grace Powell).
As reported by the Columbus Dispatch newspaper and others, the WCS/GBC administrators and their SZD (now Ice Miller) attorney got caught while deliberately and willfully putting thousands of students at “big-time liable” “risk” (Jim Augspurger's own secretly-recorded words) with several repeat child molesters led into temptation to molest again, while conspiring to deceive and defraud we the parents about it for over 10 years.
The overwhelming and irrefutable evidence proves they are clearly guilty of a 10-year Conspiracy of Child Endangerment, Criminal Negligence, Deception, Fraud, and Cover-Ups committed against thousands of consumers and children involving millions of dollars.

Worthington Christian Schools (WCS) is an educational ministry of the Grace Brethren Church (GBC) of Columbus, Ohio. It costs about $60,000.00 for a student to attend WCS for 14 years from PK-12.

Without ever warning the parents or students, the WCS/GBC administrators knowingly hired admitted and continued to employ accused child molesters as Teachers, Girl's Coaches, and Youth Directors. These administrators clearly understood that these child molesters would be tempted to molest again and that there was indeed a "risk" to literally thousands of WCS students over the years of being molested. WCS/GBC intentionally withheld this crucial information from the unsuspecting WCS parents and students for 10 years till the administrators were finally caught endangering the students and deceiving the parents during the "cover-up" that was discovered. Those child molesters would still be employed at WCS today if the Columbus Dispatch newspaper had not learned of the truth and reported the facts to the unsuspecting WCS parents and students. Refer to the Columbus Dispatch newspaper: Wednesday, October 17, 2007 and the WBNS-10TV story: Tuesday, October 23, 2007 for details.

To address these offences against the parents who paid WCS for a safe Christian education for their children, WCS parents expect WCS and GBC to immediately fire all those who were aware of the danger and deceit. This includes terminating the Assistant Superintendent Troy McIntosh who claims he was completely unaware of the danger and deceit, which is virtually impossible, who has also demonstrated gross incompetence by not investigating the rumors, and who has proven to be a highly ineffective leader by not being informed or aware of what the other WCS/GBC administrators and some teachers, staff, parents, and students in the school and church knew to be true.

We regret to inform you that the BBB cannot process your complaint. The case has been reviewed and was found to contain issues that are out of the BBB's Purview and/or the case does not meet our BBB Complaint Acceptance Policy.

In follow-up to BBB's previous correspondence with you, this case was further reviewed by management and we have decided to re-open the complaint.

The nature of your complaint and the resolution sought still may be beyond the scope of traditional BBB dispute resolution services concerning the sale of products and services in the marketplace.

It isn't clear if you are a direct customer disputing the terms of your contract with this private school. Or if you are alleging criminal violations of individuals other than theft by company employees while performing services.

And the resolution you request is to have all those involved fired and replaced. This is not within the usual range of options to settle a marketplace complaint, such as a refund, or a change in a company's customer service, selling or advertising practices.

However, to extend every possible opportunity for resolution, BBB has returned the case to a pending status. And we will send a copy of your complaint to the school and offer the school an opportunity to review and respond to your complaint through BBB.

Thank you for the information. Your assistance is highly appreciated.

Yes, we were direct customers of the school. Our son attended the school for 14 years for pre-kindergarten, kindergarten, and grades 1 through 12. He graduated last year in 2007. In October 2007, the Columbus Dispatch learned about and informed the parents that child molesters were teaching and coaching students for the previous 10 years at the school. Obviously, we would not have enrolled our son in the school if we had known the school was endangering the students and deceiving the parents about child molesting teachers and coaches. The students were in danger for 10 years (1998-2007) with the admitted child molester Dwayne Smith and for at least 6 years (2002-2007) with the accused (later convicted on January 24, 2008) child molester Jason Crary.

The school was also using "Deceptive Sales Practices". Evidence of this includes statements such as the following that were made by the school about the admitted repeat child molester:
"His last background check, July 31, 2006 was spotless."
However, the school knew full well that the man admitted to repeatedly molesting a 13 year old girl and then later claimed that:
"She had been coming on to me for a while."

WCS/GBC intentionally misrepresented the truth as they withheld crucial information from the parents. The the parents relied upon the claims made by WCS/GBC and WCS/GBC benefited monetarily from the parents due to those misleading claims.

The school is also guilty of "Child Endangerment". Evidence of this includes a recording, as reported by the Columbus Dispatch, made during a school administrator meeting where one of the administrators stated that:
"We understand that if something happens between Dwayne (the admitted child molester) and a student, we will be big-time liable," "That's a risk we take."

The list below is of the WCS/GBC administrators who were fully aware of the danger to the students, temptations of the child molesters, deceit against the parents, and the cover-up:

  1. Previous WCS School Superintendent Taylor Smith (father of admitted child molester)
    (Taylor Smith is now the ACSI Vice President of Executive Support)
  2. GBC Outgoing Senior Pastor Jim Custer
  3. GBC Executive Pastor Jim Augspurger
  4. WCS School Superintendent Bill Williams
  5. WCS High School Principal Tom Anglea
  6. WCS Counseling/Bible/Psychology Teacher Buzz Inboden

It is important to note that the WCS Assistant Superintendent, Troy McIntosh, claims that he had no idea that child molesters were teaching and coaching students at WCS till the Fall of 2007 (Note: Fall 2007 began on Sunday, September 23). However, it is nearly impossible that he was unaware of this because of the following reasons:

  1. The other WCS administrators were aware of both child molesters.
  2. Some WCS teachers, staff, parents, and students were aware of at least the admitted child molester.
  3. WCS/GBC claimed that there were other teachers and/or staff monitoring the admitted child molester to prevent him from molesting another child.
  4. Some WCS parents and students have claimed that there was a "well known rumor" about the admitted child molester.

After the school was caught covering up the facts for 10 years, Troy McIntosh informed the Columbus Dispatch newspaper that WCS/GBC "don't apologize" for their decision (Columbus Dispatch: Wednesday, October 17, 2007). Nearly a week later, Troy McIntosh informed WBNS 10 TV that WCS/GBC "did not regret their decision" (WBNS-10TV: Tuesday, October 23, 2007).

If you like, the complaint can be modified to more accurately meet the requirements of the Better Business Bureau. For example, if it is not possible to request that those responsible be fired, the complaint can be modified to request a refund.

As you have probably already determined, there are people at WCS/GBC who are doing everything possible to prevent the truth from being known as they try to protect those who deceived and endangered the consumers for a decade and who still remain as a threat to unsuspecting consumers.

I will be sure that the new Internet address/password is not available to anyone in any way and I will investigate how the person who did make that entry might have acquired that address.

Thank you for the information about Worthington Christian Schools (WCS) refusing to be accountable for their offenses against their customers (i.e. the WCS students and parents). I do appreciate the time and efforts from those of you employed at the Better Business Bureau (BBB).

I do not understand how requesting a refund from a school that profits from it's customers while willfully deceiving and defrauding those customers by using "Deceptive Sales Practices" is "beyond the scope of traditional BBB dispute resolution services".

However, I do understand that the BBB is powerless to do anything about the matter, but I do not believe it is beyond your scope as it applies to protecting and keeping consumers informed.

Since WCS does acknowledge that the students were put at "risk" with child molesters for at least 8 years while the school and church did indeed deceive the consumers about it, is the BBB now going to assign WCS an "Unsatisfactory" rating on the associated BBB web page?

Or, will the BBB now pressure WCS to become a paying BBB member so WCS can get (buy) a "Satisfactory" rating as I personally and many other consumers have observed the BBB do in other BBB cases? As we know, the BBB is simply a private organization that is in business to profit from funding they receive from their local business members.

A brief description of the facts in the consumer complaint follows:

Worthington Christian Schools (WCS) is an educational ministry of the Grace Brethren Church (GBC) of Columbus, Ohio. It costs consumers about $60,000.00 for a student to attend WCS for 14 years from PK-12.

Without ever warning the consumers (i.e. parents and students), the WCS/GBC administrators willfully hired admitted and continued to employ accused (now imprisoned) repeat child molesters as Teachers, Girl's Coaches, and Youth Directors. These administrators clearly understood that these repeat child molesters would be tempted to molest children again and that there was indeed a "risk" to literally thousands of WCS students over the years of being molested. WCS/GBC willfully and intentionally withheld this crucial information from the unsuspecting consumers while endangering, deceiving, and defrauding those consumers. After continuously betraying the consumers for over eight (8) years, the WCS/GBC administrators were finally "caught" during their "cover-up" that was keeping the consumers from learning about the dangers to their children with the repeat child molesters being protected at WCS.
These offenses against the consumers have harmed the WCS students' "Christian" upbringing, education, reputation, and psychological well-being.

Those repeat child molesters would still be employed at WCS if the Columbus Dispatch newspaper had not learned of the truth and reported the facts to the unsuspecting consumers.

WCS is guilty of willful Child Endangerment as WCS/GBC officials acknowledged between one another that there was indeed a "risk" to the students as Executive Pastor Jim Augspurger said on a recording (Columbus Dispatch of Wednesday, October 17, 2007):
"We understand that if something happens between Dwayne and a student, we will be big-time liable," "That's a risk we take."

WCS is guilty of willful Fraud and using "Deceptive Sales Practices" by making claims such as:
"His last background check, July 31, 2006 was spotless"
while they knew the man was an admitted repeat child molester who blamed his victim. WCS/GBC intentionally misrepresented the truth as they withheld crucial information from the parents. The the parents relied upon the claims made by WCS/GBC and WCS/GBC benefited monetarily from the parents due to those fraudulent claims.

WCS is guilty of working to Cover-Up these offenses against the consumers while protecting their repeat child molesters and themselves from being caught as indicated in the audio recording CoverUp.mp3.

WCS is guilty of willfully squandering money, intended for educating the students, for an investigation that was merely an attempt to avoid being held accountable after they got "caught" committing these offenses against and harms to the consumers.

WCS is guilty of willfully breaking and ignoring laws, rules, and regulations (e.g. Child Molesters not allowed within 1,000' of a school) while also ignoring rules of their current Child Protection Plan (CPP) which was adopted merely in an attempt to avoid being held accountable for their offenses against and harms to the consumers after they got "caught".

It is worthy to note that the hired admitted repeat child molester is the son of the then WCS Superintendent (now the Association of Christian Schools International (ACSI) Vice President of Executive Support).
Note too that both repeat child molesters and an imprisoned gunpoint rapist all graduated from WCS in three consecutive years of one another and all three sex offenders have been employees at WCS/GBC in close contact with children of all ages.
Also, the recent WCS Superintendent, who was a WCS teacher of the above sex offenders, claims to have only had an "inappropriate emotional attachment" with a student after several child molestation allegations were made against him.

Those responsible for the offenses to and harms against the WCS consumers remain in control at WCS/GBC and thus remain as a serious threat to unsuspecting consumers.

To address these willful offenses against and harms to me and my family by WCS, I am requesting a refund.

Second Opinion Responses

Below are examples of the various "second opinion" responses from approximately 30 (so far) BBBs that responded of 116 contacted. Most responses were that of the first example:

Example 1:
Thank you for contacting us regarding your experience. This issue involves a company that is located outside our service area. It is BBB's standard procedure to forward correspondence to the BBB that serves the area where the company is located. You may wish to contact the Council of BBB about your concerns. Their office can be contacted via email at contact@council.bbb.org or via mail to The Council of Better Business Bureaus, 4200 Wilson Blvd, Suite 800, Arlington, VA 22203-1838.

Example 2:
This is absolutely beyond the BBB scope of dispute resolution services, due to the fact that this contains legal criminal actions, you would need to contact a legal agency for this complaint. Perhaps the Attorney General for your state or you may need a personal attorney.

Example 3:
I do understand the concern you feel about having something such as you described in your email going on in your community. However, this is something for local law enforcement and children’s welfare to handle. The Better Business Bureau is not a legal agency and has no jurisdiction over any sort of legal matter. That is why your concerns are out of our scope. It isn’t that we are not concerned; it’s that we have no legal right to contact the school regarding the information, because we can’t make them stop or even admit to their guilt. That is for the courts to decide, not the BBB. I hope this has answered your questions.

Example 4:
If you have been informed that this is beyond the scope of the traditional BBB dispute resolution services, that is correct. It’s quite simple why the BBB cannot handle a complaint of this magnitude. BBB complaint standards say:

BBB generally does not handle complaints which are more effectively handled by other government or private agencies or the legal system, such as complaints involving employment practices, discrimination, or matters in litigation. Also, it does not handle complaints alleging criminal violations by company employees.
The situation you describe (and I understand why you are distressed by it) hits all those things….something that alleges criminal activity by a company employee in nature (BBBs are not government agencies and therefore do not have the ability to enforce law against a company) and thus is more effectively handled by government agencies and/or the legal system (which it sounds like is happening to some extent, based on the information you provided.) And, it sounds like the matter is in litigation. If the courts have it, the BBB has no jurisdiction over it.

Example 5:
Yes, I do believe that it is beyond our scope. Does your state not have laws that require offenders to not engage in this type of employment? If so, this is criminal. Call the police. Call the mayor. Call the Attorney General. Call the governor. You need someone with law enforcement capabilities. The BBB is not a government or enforcement agency. You need legal advise.

Example 6:
As for the scope of BBB dispute resolution services, this is set on a national level by the Council of Better Business Bureaus (CBBB). Dave Johnson is the Director of Standard and Policy; he may be reached at the CBBB at 703-276-0100, djohnson@council.bbb.org and can either advise you or put you in touch with someone who can advise whether or not this situation falls within the BBB's purview.

It is our policy to process only those complaints that fall into the BBB's scope. Items such as landlord/tenant issues, criminal allegations, requests for punitive damages, employer/employee disputes, cases already involved in litigation, civil right violations, business to business collection issues, etc are not handled by the BBB.

As a general rule, the BBB handles no cases which in any way concern legal matters. However, we would like to refer you to the BBB location serving the Columbus area, who may have further information for you, or a different set of criteria regarding which complaints to handle.

I reviewed the BBB "Complaint Acceptance Guidelines" on the BBB web site. Those guidelines include the following:

"The complaint must involve a consumer-to-business or business-to-business transaction that relates to the advertisement or sale of a product or service."
This complaint involves a 14 year long "consumer-to-business transaction" of about $60,000.00 that relates to the advertisement and sale of a service. That is, a safe and respectable education based on "Christian" values; that is: "safety, honesty, and integrity" versus "danger, deception, and hypocrisy".

However, the BBB Guidelines also indicate that:

"Some types of complaints are more effectively handled by government agencies with specific expertise, or the legal system. Therefore, BBB generally does not handle complaints involving:"

"matters which are or have previously been in litigation"

Because this complaint has criminal elements to it (e.g. Child Endangerment, Deception, Fraud, Cover-Ups, etc.), it appears that the BBB suggests that this matter be taken to court in a lawsuit because it would be more effectively handled by a Judge and Jury. This could also be the most effective way to warn unsuspecting consumers, as well as prevent current easily-manipulated consumers again, from being endangered, deceived, and defrauded by this school that practices danger, deception, and hypocrisy which greatly harms the students' "Christian" upbringing, education, reputation and their psychological well-being for the rest of their lives.

As some have suggested, I will contact the Council of BBBs at contact@council.bbb.org and Dave Johnson, the Director of Standard and Policy, at djohnson@council.bbb.org to confirm that this is why the consumer complaint against WCS is "beyond the scope of traditional BBB dispute resolution services".

WCS is guilty of willful Child Endangerment as WCS/GBC officials acknowledged between one another that there was indeed a "risk" to the students as Executive Pastor Jim Augspurger said on a recording (Columbus Dispatch of Wednesday, October 17, 2007):
"We understand that if something happens between Dwayne and a student, we will be big-time liable," "That's a risk we take."

WCS is guilty of willful Fraud and using "Deceptive Sales Practices" by making claims such as:
"His last background check, July 31, 2006 was spotless"
while they knew the man was an admitted repeat child molester who blamed his victim. WCS/GBC intentionally misrepresented the truth as they withheld crucial information from the parents. The the parents relied upon the claims made by WCS/GBC and WCS/GBC benefited monetarily from the parents due to those fraudulent claims.

WCS is guilty of working to Cover-Up these offenses against the consumers while protecting their repeat child molesters and themselves from being caught as indicated in the audio recording CoverUp.mp3.

WCS is guilty of willfully squandering money, intended for educating the students, for an investigation that was merely an attempt to avoid being held accountable after they got "caught" committing these offenses against and harms to the consumers.

WCS is guilty of willfully breaking and ignoring laws, rules, and regulations (e.g. Child Molesters not allowed within 1,000' of a school) while also ignoring rules of their current Child Protection Plan (CPP) which was adopted merely in an attempt to avoid being held accountable for their offenses against and harms to the consumers after they got "caught".

It is worthy to note that the hired admitted repeat child molester is the son of the then WCS Superintendent (now the Association of Christian Schools International (ACSI) Vice President of Executive Support).
Note too that both repeat child molesters and an imprisoned gunpoint rapist all graduated from WCS in three consecutive years of one another and all three sex offenders have been employees at WCS/GBC in close contact with children of all ages.
Also, the recent WCS Superintendent, who was a WCS teacher of the above sex offenders, claims to have only had an "inappropriate emotional attachment" with a student after several child molestation allegations were made against him.

Those responsible for the offenses against and harms to the WCS consumers remain in control at WCS/GBC and thus remain as a serious threat to unsuspecting consumers as well as to the remaining careless and easily-manipulated consumers.

To address these willful offenses against and harms to me and my family by WCS, I am requesting a refund.

QUESTIONS:

  1. Is this matter indeed beyond the scope of traditional BBB dispute resolution services?
  2. Does the BBB recommend that this matter be addressed in a court of law? This may be most effective way to warn unsuspecting consumers, as well as to prevent the remaining careless and easily-manipulated consumers again, from being endangered, deceived, and defrauded by this school that practices and teaches by example danger, deception, and hypocrisy which greatly harms the students' "Christian" upbringing, education, reputation and their psychological well-being for the rest of their lives.
